Mike Smith is assistant general counsel for the National Trust for Historic Preservation.
As a member of the organization's Legal Defense Fund, Smith represents the National Trust in federal and state litigation. He also represents the organization on a wide range of federal, state and local advocacy issues relating to the enforcement of historic preservation laws, including the National Historic Preservation Act, Section 4(f) of the Department of Transportation Act, and/or the protection of significant historic properties. Smith also provides corporate legal services to and on behalf of the National Trust.
Smith has extensive involvement with Section 106 of the National Historic Preservation Act, particularly in the context of federal actions. He works closely with other organizations and tribes, providing legal assistance on issues relating to the National Historic Preservation Act, as well as other statutes, regulations and executive orders that guide federal agencies in historic preservation.
Smith has lectured on a variety of preservation topics, such as the application of Section 106 to federal action approving oil and gas leasing on public lands, and more generally on federal preservation and environmental laws, including the National Historic Preservation Act, Section 4(f) and the National Environmental Policy Act.
Smith earned a B.A. in History from the University of Utah in 1997. He received his J.D. from Vermont Law School in 2002.
