This Place Matters Terms and Conditions
PERMISSION AND RIGHTS GRANTED:
By submitting photographs, films, or recordings (works) to the National Trust for Historic Preservation (National Trust) you agree to the following terms and conditions:
1.) You retain the all rights to any photograph submitted and grant to the National Trust a perpetual, royalty-free, fully transferable, unconditional, non-exclusive, irrevocable worldwide license to reproduce, distribute, or publicly display the photographs in any and all media for any editorial, commercial, promotional, or trade purposes.
2.) You hereby waive your right to inspect or approve any copy that is used in connection with the work(s) in any existing or subsequently developed medium, and you agree to release and discharge the National Trust, including its affiliates and licensees, from any and all claims arising out of such use for the purposes described above, including any claims for libel and invasion of privacy.
3.) You represent and warrant that: (a) You are the sole owner of, or otherwise have the authority to grant, all rights herein granted to the National Trust; and (b) photograph(s) submitted does not infringe upon any copyright, trademark, moral rights, rights of privacy, intellectual property rights or other proprietary right of any person or entity, nor does it contain libelous, scandalous, or unlawful material.
4.) For photographs in which a person is recognizable, You must be prepared to provide a release form, as for all recognizable people in the photo, or in the case of a minor, the subject’s parent or guardian, and provide to the National Trust upon request.
4.) You are over the age of 18 years of age and have the full legal capacity to execute this release.
5.) If a dispute arises between You, the National Trust or other Third Party Claimant, the sole remedy on behalf of the National Trust is immediate removal of the photograph(s) from the website.
